POS 301 Topic 2 DQ 1
The defence of marriage act DOMA is a USA federal law which had defined marriage for the purpose of the federal as the union between a single man and a single woman being ruled and allowed states not to recognize similar sex marriages which was granted under the law of the country of the United States of America.
This act was meant to impose a sense of denial of the so mentioned rights and freedoms. The U.S Supreme Court made sure to create constraints between the law and the logic of the society hence there was a compromise on the side of the law. Therefore, the same sex marriages lost recognition and honour in the United States of America. The participants were not subjected to marriage privileges like the opposite sex marriage partners. This might be a perfect example of the checks and balances of the legislative and the judicial branches of the government as it is meant to ensure improved functionality of the two branches by creation of a compromise on one side.
The U.S Supreme court has the mandate to make the ruling as given by the powers it holds since it is a body that has to employ logic and other beliefs to ensure efficiency in implementation and adherence to the law.
